ez Home Search, Inc. doing business as Sure Send ("us", "we", or "our") is committed to combating illegal robocalls, fraudulent activities, and other abusive uses of telecommunications services. This Acceptable Use Policy outlines the strict requirements and responsibilities Sure Send's Clients ("you" or "your") must adhere to when utilizing our network for outbound voice traffic.
Adherence to this AUP is a condition of service and failure to comply with this AUP may result in suspension from Sure Send's Services.
By using Sure Send's Services, you agree to the following:
You shall not use our services to originate any calls that violate federal or state telemarketing laws and regulations, including, but not limited to, the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), or any state-specific Do Not Call (DNC) list requirements. This includes, without limitation, initiating calls using an automatic telephone dialing system (ATDS) or artificial/prerecorded voice without the legally required prior express consent.
You are solely responsible for obtaining and maintaining all necessary prior express consent, particularly for telemarketing or prerecorded/artificial voice calls, from all called parties as required by all applicable federal and state laws and regulations. You must be able to provide verifiable proof of such consent upon our request.
Our services shall not be used for any fraudulent, abusive, harassing, or illegal purpose, including but not limited to perpetrating scams (e.g., tech support scams, imposter scams), phishing, illegal debt collection, or any activity that causes harm or disrupts network operations.
You agree to promptly cooperate with all reasonable requests for information from us, law enforcement, or regulatory bodies (e.g., FCC, FTC) regarding call traffic, origination, consent, and your compliance with this AUP and applicable laws. This includes providing call detail records, consent records, and other relevant documentation.
You must provide and maintain accurate, complete, and up-to-date identification and contact information with us. Any changes to your contact information or operational details must be communicated promptly.
Failure to comply with this AUP may result in immediate suspension or termination of your services, without notice, and may lead to legal action, including civil penalties and reporting to relevant authorities. We reserve the right to block, filter, or re-route traffic deemed non-compliant with this AUP.
