A. Illegal or Harmful Content

• Any illegal activity or content, including fraud, money laundering, or violating export control laws
• Content that promotes or facilitates violence, terrorism, or harm to individuals or groups
• Child exploitation or abuse in any form
• Human trafficking or exploitation
• Sale or promotion of illegal drugs, controlled substances, or drug paraphernalia
• Weapons, explosives, or hazardous materials

B. Spam and Unsolicited Communications

• Sending unsolicited bulk emails, text messages, or other communications (spam)
• Using purchased, rented, or third-party email or phone lists without proper consent
• Sending messages to individuals who have opted out or unsubscribed
• Failing to include a clear and functional unsubscribe mechanism in marketing messages
• Using deceptive subject lines, headers, or sender information
• Harvesting or scraping email addresses or contact information without permission

C. Malicious or Abusive Behavior

• Transmitting viruses, malware, ransomware, or other harmful code
• Phishing, social engineering, or attempting to deceive recipients
• Hacking, unauthorized access, or attempting to breach security measures
• Denial-of-service attacks or any activity that disrupts or degrades the Service
• Impersonating another person, entity, or falsely stating or misrepresenting your affiliation
• Harassment, abuse, threats, or intimidation of any individual or group

D. Intellectual Property Violations

• Infringing on copyrights, trademarks, patents, or other intellectual property rights
• Distributing pirated software, media, or other copyrighted content without authorization
• Using Sure Send to facilitate intellectual property theft or infringement

E. Fraudulent or Deceptive Practices

• Pyramid schemes, multi-level marketing scams, or "get rich quick" schemes
• Investment fraud, securities fraud, or offering unregistered securities
• Identity theft or stealing personal information
• Creating fake or misleading accounts, profiles, or businesses
• False advertising or promoting deceptive products or services

F. Inappropriate or Offensive Content

• Pornography, sexually explicit content, or adult services
• Hate speech, discrimination, or content that promotes bigotry or intolerance
• Defamatory, libelous, or slanderous content
• Graphic violence or disturbing content intended to shock or offend

G. Service Abuse

• Excessive use of the Service that degrades performance for other users
• Circumventing usage limits, access controls, or payment requirements
• Using automated tools (bots, scripts, scrapers) without authorization
• Reverse engineering, decompiling, or attempting to extract the source code of the Service
• Reselling, sublicensing, or sharing your account with unauthorized users

H. Privacy Violations

• Collecting, storing, or using personal information without proper consent
• Violating privacy laws such as GDPR, CCPA, CAN-SPAM, TCPA, or other applicable regulations
• Sharing or disclosing personal information without authorization

3. COMPLIANCE WITH ANTI-SPAM LAWS

If you use Sure Send to send marketing or promotional messages, you must comply with all applicable anti-spam laws, including but not limited to:

• CAN-SPAM Act (United States): Include accurate sender information, provide a clear opt-out mechanism, and honor opt-out requests within 10 business days
• TCPA (Telephone Consumer Protection Act): Obtain prior express written consent before sending automated text messages or making automated calls
• GDPR (General Data Protection Regulation): Obtain lawful consent for processing personal data and provide individuals with rights to access, correct, and delete their data
• CASL (Canada's Anti-Spam Legislation): Obtain consent before sending commercial electronic messages and include identification and unsubscribe information

You are solely responsible for ensuring compliance with these and any other applicable laws in the jurisdictions where you operate and where your recipients are located.

4. MONITORING AND ENFORCEMENT

We reserve the right to monitor your use of the Service to ensure compliance with this AUP, our Terms of Service, and applicable laws. We may investigate suspected violations and take appropriate action, including but not limited to:

• Issuing warnings or notices of violation
• Suspending or restricting access to the Service
• Terminating your account without notice or refund
• Removing or disabling content that violates this AUP
• Reporting violations to law enforcement or regulatory authorities
• Taking legal action, including seeking damages and injunctive relief

We are not obligated to monitor the Service, but we may do so at our sole discretion. We are not responsible for user content and do not endorse, support, or guarantee the accuracy of any user-generated content.

5. REPORTING VIOLATIONS

6. CONSEQUENCES OF VIOLATIONS

Violations of this AUP may result in immediate suspension or termination of your account, without prior notice or refund. Depending on the severity of the violation, we may also:

• Cooperate with investigations or legal proceedings
• Ban you from creating future accounts or using our services
• Seek monetary damages or other legal remedies

You are liable for any damages, losses, or costs we incur as a result of your violation of this AUP, including legal fees, regulatory fines, and harm to our reputation or Service.

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ez Home Search, Inc., Sure Send, and our affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of this AUP or your use of the Service.

8. CHANGES TO THIS POLICY

We may update this Acceptable Use Policy from time to time to reflect changes in our practices, legal requirements, or industry standards.
